1. AGREEMENT OVERVIEW

This Customer Purchase Agreement ("Agreement") governs all purchases made on the Jinxxy platform ("Service"). By making a purchase, you agree to be bound by this Agreement, our Terms of Service, and Privacy Policy. This Agreement is in addition to and supplements our Terms of Service.

Key Definitions:

  • "Content" means digital assets, including avatars, models, textures, scripts, tools, clothing, accessories, worlds, environments, and other digital materials
  • "Creator" means the user who uploads and sells Content
  • "Buyer" (you) means the purchaser of Content
  • "License" means the terms under which Content is made available for use

2. PURCHASE PROCESS

2.1 Account Requirement

You must have a valid Jinxxy account to make purchases. You are responsible for maintaining accurate account information and securing your login credentials.

2.2 Age Requirements

  • You must be at least 13 years old to make purchases
  • Users under 18 must have parental consent
  • Adult content purchases require verification that you are 18 years or older

2.3 Order Confirmation

When you place an order:

  • You will receive an order confirmation email
  • The purchase becomes final upon payment authorization
  • You gain access to download or use the Content according to its license terms

2.4 Payment Authorization

By providing payment information, you:

  • Authorize us to charge the specified amount
  • Represent that you are authorized to use the payment method
  • Agree that all information provided is accurate and current

3. PRICING AND PAYMENT

3.1 Displayed Prices

  • All prices are displayed in USD unless otherwise specified
  • Prices include applicable platform fees
  • Taxes will be calculated and added at checkout where required

3.2 Payment Processing

  • We act as merchant of record for all transactions
  • Payments are processed through secure third-party payment processors
  • We collect and remit applicable sales taxes, VAT, and other transaction taxes

3.3 Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, MasterCard, American Express, Discover)
  • Debit cards
  • Other payment methods as displayed during checkout

3.4 Failed Payments

  • Orders with failed payments will not be processed
  • Multiple failed payment attempts may result in account restrictions
  • You are responsible for ensuring sufficient funds and valid payment information

4. CONTENT DELIVERY AND ACCESS

4.1 Digital Delivery

  • Content is delivered digitally through download links or platform access
  • Delivery typically occurs immediately after successful payment
  • You are responsible for downloading Content within any specified time limits

4.2 Download Requirements

  • You must have appropriate software and hardware to use purchased Content
  • We do not guarantee compatibility with specific platforms or software versions
  • Technical requirements are specified in product descriptions where applicable

4.3 Access Rights

  • You receive access rights according to the Content's specified license terms
  • Access may be limited by the number of downloads or usage restrictions
  • We maintain the right to serve Content to you indefinitely after valid purchase

4.4 Backup Responsibility

  • You are responsible for creating your own backups of purchased Content
  • We are not liable for loss of downloaded Content due to hardware failure, software issues, or other causes
  • Re-download capabilities may be limited or restricted

5. LICENSING AND USAGE RIGHTS

5.1 License Agreement

  • Each purchase includes a license to use the Content according to specified terms
  • License terms are displayed on the product page at time of purchase
  • If no specific license is displayed, our Jinxxy Asset License (JAL) applies by default

5.2 License Binding at Purchase

  • License terms effective at the time of purchase govern your use
  • Creators cannot retroactively change license terms for completed purchases
  • You must comply with all applicable license restrictions and requirements

5.3 Common License Restrictions

Typical restrictions may include:

  • Personal use only vs. commercial use permissions
  • Prohibition on redistribution or resale
  • Attribution requirements
  • Modification limitations
  • Platform-specific usage restrictions

5.4 License Violations

  • Violation of license terms may result in access revocation
  • Creators may pursue legal action for license violations
  • We may assist in enforcement but are not obligated to monitor compliance

6. REFUND POLICY

All sales are final. Refunds are only provided under limited circumstances as outlined in our refund policy.

7. CONTENT QUALITY AND WARRANTIES

7.1 Creator Responsibility

  • Creators are solely responsible for Content quality and accuracy
  • Product descriptions and previews are provided by Creators
  • We do not verify or guarantee Content functionality or quality

7.2 Platform Disclaimers

We provide the marketplace platform "AS IS" and disclaim warranties regarding:

  • Content functionality or compatibility
  • Accuracy of product descriptions
  • Freedom from defects or errors
  • Fitness for particular purposes

7.3 Creator Support

  • Technical support for Content is provided by the Creator
  • Contact information for Creator support may be available on product pages
  • We may facilitate communication but are not responsible for Creator responsiveness

8. PROHIBITED USES

8.1 License Compliance

You must not:

  • Use Content beyond the scope of your license
  • Redistribute, resell, or share Content without permission
  • Remove copyright notices or attribution requirements
  • Use Content for illegal or harmful purposes

8.2 Platform Abuse

You must not:

  • Attempt to reverse engineer or extract Content beyond license terms
  • Share account access or download links with others
  • Use automated systems to make purchases or access Content
  • Engage in fraudulent purchasing activity

8.3 AI and Machine Learning

  • Content may not be used for training AI models or machine learning systems
  • Automated scraping or downloading for AI purposes is prohibited
  • This applies regardless of license terms unless explicitly permitted

9. DISPUTE RESOLUTION

9.1 Creator Disputes

  • Content-related issues should first be addressed with the Creator
  • We may facilitate communication but are not party to Creator-Buyer disputes
  • Unresolved disputes may be eligible for platform mediation at our discretion

9.2 Payment Disputes

  • Payment disputes must be resolved through our support system
  • Chargebacks may result in account suspension pending investigation
  • False chargeback claims may result in account termination

9.3 Platform Disputes

  • Disputes with Jinxxy are subject to binding arbitration as outlined in our Terms of Service
  • You waive rights to class action participation
  • Florida law governs all agreements

10. ACCOUNT TERMINATION

10.1 Effect on Purchases

  • Account termination does not affect your rights to previously purchased Content
  • You retain access to validly purchased Content according to license terms
  • Outstanding refund requests will be processed according to policy

10.2 Violation-Based Termination

  • Accounts terminated for Terms violations may forfeit access to purchases
  • Fraudulent activity may result in loss of purchase rights
  • We reserve the right to refuse service to terminated users

11. LIMITATION OF LIABILITY

11.1 Platform Liability

Our total liability for any purchase-related claims shall not exceed the amount you paid for the specific Content in question.

11.2 Excluded Damages

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Content-related issues beyond our direct control
  • Third-party actions or Creator misconduct

11.3 Time Limitations

Claims must be brought within one (1) year of the purchase date or when the issue was discovered.

12. MODIFICATIONS TO AGREEMENT

12.1 Updates

We may update this Agreement at any time by posting the revised version on our website. Changes become effective immediately upon posting.

12.2 Continued Use

Your continued use of the Service and making purchases after changes constitutes acceptance of the updated Agreement.

12.3 Notification

We will provide reasonable notice of material changes through email or prominent website notices.

13. EXPORT CONTROLS

13.1 Compliance Required

You must comply with all applicable export control laws and regulations when purchasing and using Content.

13.2 Prohibited Countries and Persons

You may not purchase Content if you are:

  • Located in a country subject to U.S. embargo
  • On any U.S. government prohibited party list
  • Restricted under applicable international sanctions

15. ENTIRE AGREEMENT

This Agreement, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Jinxxy regarding purchases. If there are conflicts between this Agreement and the Terms of Service, this Agreement takes precedence for purchase-related matters.

BY MAKING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS CUSTOMER PURCHASE AGREEMENT.
