3.3 Processing Timeline

  • Provide information about the counter-notification process

4. COUNTER-NOTIFICATION PROCEDURE

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification.

4.1 Required Elements

Your counter-notification must include:

  1. Your physical or electronic signature

  2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification

  4. Your name, address, and telephone number

  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Southern District of Florida if you are outside the United States)

  6. A statement that you will accept service of process from the person who provided the original notification or their agent

4.2 Counter-Notification Process

Upon receipt of a valid counter-notification:

  • We will promptly forward a copy to the original complainant
  • We will inform them that we may replace the removed material or cease disabling access within 10-14 business days
  • Unless the copyright owner files a court action seeking a restraining order against the content provider, we will replace or restore access to the removed material within 10-14 business days after receiving the counter-notification

5. REPEAT INFRINGER POLICY

5.1 Account Termination

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

5.2 Strike System

We maintain a strike system for copyright infringement:

  • First Strike: Warning and content removal
  • Second Strike: Warning, content removal, and temporary restriction of upload privileges
  • Third Strike: Account termination

5.3 Factors Considered

When determining whether a user is a repeat infringer, we may consider:

  • The number of valid DMCA notices received
  • The timeframe over which notices were received
  • Whether the user filed valid counter-notifications
  • Whether the user's conduct appears intentional or negligent
  • Any other relevant circumstances

5.4 Reinstatement

Users whose accounts have been terminated for repeat infringement may not create new accounts without our express written permission. Attempts to circumvent this restriction may result in legal action.

6. MISREPRESENTATION AND ABUSE

6.1 False DMCA Notices

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

6.2 Consequences for Abuse

Users who submit false or bad faith DMCA notices or counter-notifications may face:

  • Account suspension or termination
  • Prohibition from using our Service
  • Legal action for damages
  • Reporting to appropriate authorities

6.3 Verification

We reserve the right to:

  • Request additional information to verify the identity of complainants
  • Reject incomplete or suspicious notices
  • Take no action on notices that appear to be filed in bad faith
